The Regulations specify the terms and conditions for the sale of goods in the online store operating at: www.biotrend.be

  1. INITIAL PROVISIONS
    1. The owner of the Online Store is: bioTREND Jan Kunicki with its registered office in Piekary Slaskie (code: 41-949) at ul. M.C Sklodowskiej 105/6, registered in the register of entrepreneurs kept by CEiDG, NIP: 4980105507, REGON: 367996819, e-mail: contact@biotrend.be
    2. To use the Online Store, including viewing the Goods available in the Online Store assortment and placing orders, you need a device (e.g. a computer) with access to the Internet and a web browser: Safari, Chrome, Internet Explorer, Firefox or Opera, with support enabled cookies and FlashPlayer, Java, Javascript installed. In order to register and to place orders, it is necessary for the Customer to have an active e-mail account.
    3. Online Store customers may be adult natural persons with at least limited legal capacity and legal persons or organizational units without legal personality, legal capacity and legal capacity.
  2. DEFINITIONS
    1. Working days – all days of the week from Monday to Friday, excluding public holidays and Saturdays;
    2. Password – a unique series of characters (numbers or letters) chosen by the Customer, which the Customer provides in the Online Store system for the purpose of confirming his identity; The password is confidential and the Customer should keep it secret;
    3. Customer – any person who uses the Online Store in any way, including in particular the Consumer and the Entrepreneur;
    4. Consumer – a natural person performing a legal act not related directly to his business or professional activity;
    5. Cart – an element of the Online Store in which the Customer specifies the details of the order such as: customer data, ordered Goods, delivery address, invoice data, delivery method, payment method and other data that must be disclosed in connection with the performance of the order;
    6. Newsletter – commercial information about bioTREND, including in particular Goods, new products, promotions, etc .;
    7. Entrepreneur – a natural person who carries out business activities on his own behalf, partners in a civil law partnership in the field of their business activity, a legal person or an organizational unit whose law confers legal capacity, who carries out business activity on his own behalf;
    8. Online Store – an IT platform managed by bioTREND, enabling placing orders for Goods, operating at the following addresses: www.biotrend.be;
    9. PayPal – an online payment system operated by PayPal (Europe) S.à r.l. & Cie, S.C.A with its registered office at L-1150 in Luxembourg;
    10. Goods – products for which an order can be placed in the Online Store.
  3. ORDERS FOR PLACING ORDERS
    1. Before placing an order in the Online Store, the Customer should read these Regulations.
    2. Information about the Goods available in the Online Store’s assortment does not constitute an offer within the meaning of the Civil Code. Information about the Goods provided on the Online Store website constitutes an invitation to submit offers by customers.
    3. By placing an order in the Online Store, the Customer submits an offer to conclude a sales (purchase) agreement for the selected Good. Conclusion of a sales contract requires the Customer to place an order and then confirm to the Customer that the order has been accepted by the Online Store.
    4. Placing orders in the Online Store is possible 7 days a week and 24 hours a day, while their implementation takes place on Business Days.
    5. The Customer may place an order in the Online Store by selecting the Goods and adding them to the Cart. The Customer may place an order in the Online Store for Goods in the Online Store assortment and presented on the Online Store website.
    6. The persons authorized to place orders for Goods are the Customers:
      • having the status of registered user of the Online Store;
      • not having the status of a registered Online Store user – making purchases without registering and logging in
    7. The status of a registered Online Store user is obtained after performing the following actions:
      • completing the registration form on the Online Store’s website correctly;
      • logging in to the Online Store using the e-mail address and Password set by the Customer.
    8. The detailed procedure of registering an Online Store user is available on the Online Store website.
    9. Customers are required to store the data necessary to log in to the Online Store in a way that prevents them from being read by unauthorized third parties .
    10. The customer having the status of a registered Store user places an order by logging into the Online Store, adding the Good to the Basket, and then confirming the order for the Good by selecting the “order” and “summary” button.
    11. The customer who does not have the status of a registered Store user places the order by adding the Good to the Basket and providing the data necessary to complete the order in accordance with the procedure published on the Online Store website, and then confirming the order for the Good by selecting the “order” and “summary” button.
    12. Prices of Goods available in the Online Store at the time of the Customer’s order are binding on the Customer and bioTREND. The prices of Goods available in the Online Store are given in EUR (€) and include VAT (TAX) (they are gross prices).
    13. The price of the Good given on the Online Store website does not include the cost of shipping the Good to the Customer. The cost of delivery is added to the price of the Good, the amount of which is indicated in the Basket, before the Customer confirms the order. Shipping costs depend on the place of delivery, the value and size of the order.
    14. Payment methods :
      • The entity providing the online payment service is PayPal
      • Bank transfer
      • If there is a need to refund funds for a transaction made by the customer bioTREND, the payment will be refunded using the method chosen by the Customer
      • Placing orders in the Online Store is possible 7 days a week and 24 hours a day, while their implementation takes place on Business Days. Order processing begins when the customer authorizes the payment.
      • The customer has the right to withdraw from the contract within 14 days of delivery.
  4. ORDER FULFILLMENT
    1. bioTREND confirms the acceptance of the order by the Customer to the email address provided by the Customer when placing the order, within three days of placing the order.
    2. If the implementation of the order placed by the customer is not possible due to the lack of availability of the goods in the warehouse, bioTREND informs the customer about this fact within three days of placing the order by sending a message to the e-mail address provided by the customer. If some of the Goods covered by the order are not available, the Customer decides whether the order is to be partially or completely canceled.
    3. The customer may change or cancel the order via the email address sales@bio-trend.pl, until the ordered Goods are sent by bioTREND.
    4. In the event of canceling the order in the situation specified in paragraph 2 or paragraph 3 above, bioTREND will refund the amount paid (or part of it if the order is partially processed) to the Customer within three business days from the day the order was canceled.
    5. bioTREND reimburses payments using the same payment method that the Customer used, unless the Customer expressly agreed to a different refund method that does not incur any costs for him.
    6. Goods ordered in the Online Store are delivered to the delivery address indicated by the Customer when placing the order within seven business days from the date of sending the confirmation of order acceptance to the Customer.
    7. The condition of accepting the order for execution is prior payment for the ordered Goods. If the Customer chooses the form of electronic payment or bank transfer, bioTREND will accept the order for processing after the payment for the ordered Goods has been credited to the bioTREND bank account. If the Customer chooses the form of payment by bank transfer, the Customer should make the payment within 24 hours of placing the order.
    8. Delivery of the parcel to the customer is carried out via a courier company.
    9. Delivery of the parcel to the customer will be carried out on a business day.
    10. An attempt to deliver a parcel to the Customer via a courier company will take place in accordance with the terms of the provision of services by the courier company which services are used by bioTREND, as specified in the regulations for the provision of services by the courier company. In the absence of effective delivery of the parcel to the Customer, the Goods will be returned to the Online Store, about which the Customer will be notified via e-mail to the e-mail address provided when placing the order .
    11. bioTREND delivers the goods to the customer together with a sales document in the form of a VAT invoice. The VAT invoice delivered to the Customer together with the Goods confirms the conclusion of the contract.
    12. The fees due for the delivery of ordered Goods are borne by the Customer. The amount of fees due for the delivery of ordered Goods depends on the place of delivery, the value and size of the order and is indicated in the Basket, before the Customer confirms placing the order.
    13. If the customer chooses the method of payment by bank transfer or PayPAL, the duration of the order is counted from the date of crediting the bank account or bioTREND settlement account.
  5. WITHDRAWAL FROM THE CONTRACT
    1. The Customer who is a Consumer may withdraw from the contract without giving any reason within 14 days of taking possession of the item by the Customer or a third party indicated by him other than the carrier, by submitting a bioTREND statement of withdrawal from the contract in accordance with art. 27 of the Act of 30 May 2014 on consumer rights. To comply with this deadline, it is sufficient to send a statement before its expiry.
    2. In the event of withdrawal from the contract in the manner specified in paragraph 1 above, the Customer should return the Goods to the Online Store to the following address: bioTREND Jan Kunicki, ul. M. Skłodowskiej 105/6, 41-949 Piekary Slaskie, not later than within 14 days from the day of withdrawal from the contract. To meet the deadline, it is sufficient to return the Goods before its expiry. The customer bears the direct cost of returning the Good to the Online Store.
    3. The Customer is not entitled to withdraw from the contract in the cases specified in art. 38 referred to in paragraph 1 above of the Act, incl. for contracts in which:
      • the subject of the service is a non-prefabricated item, manufactured according to the consumer’s specifications or serving to satisfy his individual needs,
      • the subject of the service is an item delivered in a sealed package, which after opening the package cannot be returned due to health protection or hygiene reasons, if the package was opened after delivery.
    4. The Customer is responsible for reducing the value of the Good as a result of using it in a way that goes beyond what is necessary to establish the nature, characteristics and functioning of the Good .
    5. In the event of withdrawal from the contract in the manner specified in paragraph 1 above, bioTREND is obliged to immediately, not later than within 14 days from the date of receipt of the Customer’s statement of withdrawal from the contract, return to the Customer all payments made by him, including the costs of delivery. If the Customer has chosen a method of delivery of the Goods other than the cheapest regular delivery method offered by bioTREND, bioTREND is not obliged to refund the additional costs incurred by the consumer.
    6. bioTREND reimburses payments using the same payment method that the Customer used, unless the Customer expressly agreed to a different refund method that does not incur any costs for him.
    7. bioTREND may withhold the reimbursement of payments received from the Customer until receipt of the item back.
  6. COMPLAINTS
    1. bioTREND undertakes to provide the Customer with Good without defects.
    2. bioTREND is liable to the Customer if the item sold has a physical or legal defect, on the terms set out in the provisions of the Act of April 23, 1964, the Civil Code.
    3. Complaints related to the non-compliance of the Goods with the contract may be submitted via e-mail to the following address: shop@biotrend.be or in writing to the following address: bioTREND Jan Kunicki, ul. M.C Sklodowskiej 105/6, 41-949 Piekary Slaskie, Poland.
    4. bioTREND will consider and respond to the complaint submitted by the Customer immediately, no later than within 14 days from the date of submission of the complaint.
    5. The customer who is a consumer has the option of using extrajudicial means of dealing with complaints and redress. In particular, the Customer may submit a request to initiate mediation proceedings to the Provincial Inspector of Trade Inspection or turn to the Permanent Consumer Arbitration Court acting at the Provincial Inspector of Trade Inspection with a request to resolve a dispute. Both parties’ consent is required to use out-of-court complaint consideration and redress methods.
    6. The customer who is a consumer has the opportunity to use the help in resolving the dispute with the seller and obtain free advice or legal information from the poviat (municipal) consumer ombudsman or social organization, whose statutory tasks include consumer protection, including Association of Polish Consumers, Consumer Federation.
  7. PERSONAL DATA
    1. bioTREND is the administrator of the set of personal data provided by the Online Store customers in connection with the execution of orders.
    2. Personal data provided by the Customer are used by bioTREND in accordance with the Privacy Policy.
  8. NEWSLETTER
    1. The Customer may agree to receive commercial and marketing information from bioTREND electronically, in the form of a Newsletter, to the e-mail address provided by the Customer.
    2. The Customer may unsubscribe from the Newsletter at any time. In each marketing message that the Seller sends, there is a special link to unsubscribe from the Newsletter. Unsubscribing from the Newsletter is also possible by sending a request by e-mail to the following address: contact@biotrend.be
  9. FINAL PROVISIONS
    1. bioTREND holds the copyright or the appropriate license for photos and content contained on the Online Store website. Copying and distribution without the consent of bioTREND is prohibited.
    2. The names of the Goods posted on the Online Store website may be protected on the basis of the provisions of the Act of 30 June 2000, Industrial Property Law.
    3. To the extent not regulated in the Regulations, generally applicable provisions of Polish law shall apply, including the Act of 23 April 1964 the Civil Code, the Act of 30 May 2014 on consumer rights, Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of data personal data and on the free movement of such data and repealing Directive 95/46 / EC and the Act of 10 May 2018 on the protection of personal data.
    4. Any disputes arising between the Customer who is not a Consumer and bioTREND will be settled by the court having jurisdiction over the bioTREND seat.
    5. bioTREND does not apply the code of good practices within the meaning of the Act of 23 August 2007 on counteracting unfair market practices.

INSTRUCTIONS TO WITHDRAW FROM THE CONTRACT

The right to withdraw from the contract

You have the right to withdraw from this contract within 14 days without giving any reason.

The deadline to withdraw from the contract expires after 14 days from the day on which you came into possession of the item or on which a third party other than the carrier and indicated by you came into possession of the item.

To exercise the right of withdrawal, you must inform bioTREND Jan Kunicki, ul. M.C Sklodowskiej 105/6, 41-949 Piekary Slaskie, e-mail: contact@biotrend.be about his decision to withdraw from this contract by means of an unequivocal statement (for example, a letter sent by post or e-mail).

To meet the deadline to withdraw from the contract, you only need to send information regarding the exercise of your right to withdraw from the contract before the deadline to withdraw from the contract.

The right to withdraw from the contract is not available if the goods were manufactured according to your specifications, or delivered in a sealed package, and these goods cannot be returned after opening the package due to health protection or hygiene reasons, if the package was opened after delivery.

Effects of withdrawal from the contract

In the event of withdrawal from this contract, we will refund you all payments received from you, including the costs of delivery (except for additional costs resulting from your chosen delivery method other than the cheapest usual delivery method offered by us), immediately, and in any case not later than 14 days from the day on which we were informed about your decision to exercise the right to withdraw from this contract. Reimbursement will be made using the same payment methods that you used in the original transaction, unless you have expressly agreed otherwise; in any case you will not incur any fees in connection with this refund.

We may withhold reimbursement until we receive the item.

Please send or return the item to us immediately, and in any case not later than 14 days from the day on which you informed us of your withdrawal from this contract. The deadline is met if you send back the item before the 14-day deadline. You will have to bear the direct cost of returning the item.

You are only responsible for reducing the value of things resulting from using it in a different way than was necessary to establish the nature, characteristics and functioning of the thing.
